These Standard Terms and Conditions govern the contractual relationship between The Cumberland Hotel and the guest for the reservation and occupancy of accommodations at the Hotel. By making a reservation with the Hotel, the Guest agrees to be bound by these Terms and Conditions.
Reservation and Payment:
1.1. All reservations are subject to availability and confirmation by the Cumberland Hotel.
1.2. The Guest agrees to provide accurate and complete information for the reservation.
1.3. Payment for the reservation is required at the time of booking, unless otherwise specified by the Hotel.
1.4. The Cumberland Hotel reserves the right to cancel any reservation if payment is not received by the specified deadline.
Cancellation and No-Show Policy:
2.1. Cancellation of reservations must be made in accordance with the Hotel's cancellation policy, as specified at the time of booking.
2.2. Failure to cancel a reservation within the specified time frame may result in a cancellation fee charged to the Guest's credit card.
2.3. In the event of a no-show, the Hotel reserves the right to charge the full amount of the reservation to the Guest's credit card.
Check-In and Check-Out:
3.1. Check-in time is 15h00, and check-out time is 10h00. Early check-in and late check-out may be available upon request, subject to availability and additional charges.
3.2. The Guest must present valid identification and a valid credit card at check-in.
3.3. The Hotel reserves the right to refuse check-in to any Guest who does not comply with these requirements.
Occupancy and Conduct:
4.1. The maximum occupancy for each room type is specified at the time of booking and must not be exceeded.
4.2. The Guest agrees to conduct themselves in a manner that is respectful to other guests, Hotel staff, and property.
4.3. The Cumberland Hotel reserves the right to refuse service or evict any Guest who engages in disruptive behavior or violates Hotel policies.
Damage and Liability:
5.1. The Guest is responsible for any damage caused to the Hotel property during their stay, including but not limited to, damage to the room, furnishings, or amenities.
5.2. The Guest agrees to indemnify and hold the Hotel harmless from any claims, losses, or damages arising from their use of the Hotel facilities.
Pets and Smoking:
6.1. Pets are allowed on the Hotel premises, with prior notice and as specified by the Hotel's pet policy.
6.2. Smoking is strictly prohibited in all indoor areas of the Hotel. A cleaning fee of ZAR 950.00 will be charged to any Guest who violates this policy.
Data Protection and Privacy:
7.1. The Cumberland Hotel collects and processes personal information provided by the Guest for the purpose of managing reservations and providing services.
7.2. The Guest's personal information may be shared with third-party service providers engaged by the Cumberland Hotel to facilitate services such as payment processing and room cleaning.
7.3. The Cumberland Hotel implements appropriate measures to safeguard the confidentiality and security of the Guest's personal information in accordance with applicable data protection laws.
7.4. By making a reservation with the Hotel, the Guest consents to the collection, processing, and sharing of their personal information as described herein.
Force Majeure:
8.1. The Cumberland Hotel shall not be liable for any failure or delay in performance arising from circumstances beyond its reasonable control, including but not limited to, acts of God, natural disasters, war, or terrorism.
Governing Law and Jurisdiction:
9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa.
9.2. Any dispute arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.
Changes to Terms and Conditions:
10.1. The Cumberland Hotel reserves the right to amend these Terms and Conditions at any time without prior notice. The Guest's continued use of the Cumberland Hotel services following any such amendment constitutes acceptance of the revised Terms and Conditions.
Severability:
11.1. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By making a reservation with the Hotel, the Guest acknowledges that they have read, understood, and agree to be bound by these Standard Terms and Conditions.
